Terms of Service

1.Who we are

Homi (“Homi”, “we”, “us”) is operated by [Company name], [address]. These Terms of Service (“Terms”) govern your use of homi.re, the agent panel and the pages we host for you (the “Service”). By creating an account or using the Service you agree to these Terms.

2.Who can use Homi

You must be at least 18 years old and able to enter into a binding contract. Homi is built for real estate professionals. If you use Homi on behalf of a brokerage or company, you confirm you are allowed to accept these Terms for it.

Where your state or country requires a license to advertise real estate, you are responsible for holding it and for showing the details your rules require (for example your brokerage name, license number and Equal Housing Opportunity logo).

3.Your account

Keep your sign-in details safe and tell us at hello@homi.re if you think someone has accessed your account. You are responsible for what happens in your account.

Your card address (homi.re/your-name) is yours to use while your account is active. We may change or reclaim an address that impersonates another person or business, infringes a trademark, or is misleading. If you change your address, the old one redirects to your card.

4.Your content

You keep all rights to the content you add: photos, text, listings, links and the like (“Your Content”). You give us a worldwide, non-exclusive, royalty-free license to host, copy, display and adapt Your Content only as needed to run the Service — for example to show your card, resize photos or create QR codes and link previews.

You confirm that you have the rights to Your Content, that listings are accurate and that you are allowed to advertise them, and that Your Content complies with applicable law, including fair housing laws and your MLS and brokerage rules. When you import a listing from a link, you are responsible for making sure you may use that information and photos.

5.Leads and your clients

Visitors to your card can send you requests (showing requests, home valuations, messages). You decide how to use them. You are responsible for following the laws that apply to contacting those people, including privacy, telemarketing and email marketing rules.

We deliver requests to you by email and keep them in your panel until you or the client asks us to delete them, or your account is deleted. See our Privacy Policy for details.

6.Acceptable use

Do not use Homi to: break the law or help others to; publish false, discriminatory or misleading listings; send spam; collect data from other users’ cards; upload malware; try to break, overload or get around the security of the Service; or impersonate anyone. We may remove content or suspend accounts that break these rules, and we will tell you why unless the law or safety prevents it.

7.Plans and payments

The Starter plan is free. Paid plans (Pro and Brokerage) are not on sale yet; prices shown on our Pricing page are planned prices and may change before launch. Joining a waitlist is free and does not oblige you to buy. When paid plans launch, their price, billing and cancellation terms will be shown before you pay, and our Refund Policy will apply.

8.Changes to the Service

We are actively building Homi and may add, change or remove features. If we remove something significant that you rely on, we will tell you in advance where reasonable. Printed QR codes keep pointing to your card while your account is active.

9.Ending your account

You can delete your account at any time in Settings → Delete account. This takes your card offline, stops your QR codes and deletes your listings and leads; it cannot be undone, so download your data first. We may suspend or close accounts that seriously or repeatedly break these Terms, or if the law requires us to.

10.Disclaimers

We work hard to keep Homi available and your requests delivered, but the Service is provided “as is” and “as available”. To the extent the law allows, we do not promise that it will be uninterrupted or error-free, and we are not responsible for the content of agents’ cards or for the dealings between agents and their clients.

11.Limitation of liability

To the extent the law allows, [Company name] will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business opportunities. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or US$100. Nothing in these Terms limits liability that cannot be limited by law.

12.Indemnity

If a third party brings a claim against [Company name] because of Your Content or your breach of these Terms or the law, you agree to cover the reasonable costs, damages and legal fees that result, to the extent the law allows.

13.Governing law

These Terms are governed by the laws of [State / Country], without regard to its conflict-of-laws rules. Disputes will be resolved in the courts of [venue], unless the law of the place where you live gives you the right to bring a claim in your local courts.

14.Changes to these Terms

We may update these Terms. If a change is material, we will email you or show a notice in your panel at least 14 days before it takes effect. If you keep using Homi after that, the new Terms apply.
